Juan Cerda Garza pled nolo contendere to murdering his common-law wife and was sentenced to 35 years imprisonment pursuant to a plea bargain. The issue on appeal is whether the trial court erred in denying Garza's motion to suppress his two written statements, which included a confession to the murder. *fn1 Garza maintains the statements resulted from a custodial interrogation and that he was not given Miranda warnings prior to making them. See Miranda v. Arizona, 384 U.S. 436 (1966). The State acknowledges Garza never received the warnings, but asserts that because he was not in custody when he made his statements, the Miranda requirements were not triggered.
